Should Tom O'Neill have Been Charged?

The police are returning to the case of a former city official who was found asleep in an idling SUV to see if it merits DUI charges.

A Tampa Bay Times investigation about police finding Port Richey City Manager Tom O’ Neill asleep behind the wheel of an idling SUV but not seeking a charge of DUI has stirred up discussion about whether O'Neill should have been charged.

According to the Times, New Port Richey police Cpl. William Phillips questioned O’Neill, who is a former city manager New Port Richey, after O'Neill was reportedly found asleep in the vehicle on A New Port Richey road July 13 .  The report says he recognized  O'Nell as a former public official in New Port Richey.  He also called officers from other departments to the scene to avoid the appearance of conflict of interest. He noted that O’Neill, New Port Richey’s former city manager, had an odor of alcohol on his breath, along with other signs of impairment, according to the Times. 

However, O’ Neill was not charged with DUI. Instead, he was taken by an ambulance  to a hospital for medical clearance.

Questioned by the Times last week, Interim New Port Richey Police Chief Kim Bogart initially said he stood by his officer's report. On Monday. however, he told the Times that he is going to review the case to see if criminal charges are warranted against O’Neill and to also look at William’s conduct. He told the Times on Tuesdaty that the State Attorney's Office is looking at the case.

He told Patch Tuesday that Phillips is back on the case and "continuing his investigation." He said he should have the results of the reviews a few days.
