Amazon Drive Lawsuit Threat ‘Disgusts’ State Officials

Developers of a proposed apartment complex on Amazon Drive want opponents to pay their legal fees or they say they’ll sue.

The battle against a proposed apartment complex in the unincorporated New Port Richey area has taken a new turn. The developers of the Oaks at Riverside say they want residents who opposethe project to pay out more than $27,000 in legal fees or they’ll sue, according to the Tampa Bay Times. The Times says the developer’s attorney, Kent G. Whittemore, mailed a letter to several neighborhood associations demanding payment by the end of the month. If the neighborhood associations, which include Heritage Lake and Cedarwood Village in the Trinity area, don’t pay up, Whittemore’s letter said action would be taken. “My client will have no alternative but to seek its full damages against all of those legally responsible,” the Times quoted the …

This wouldn't be the first lawsuit in Pasco County where a landowner or developer has sued adjoining land owners over code enforcement complaints or objections to a development. Unfortunately, they are trying to stop due process and a resident's right to object or complain. Amazon Drive Apartment Decision Delayed

It remains unclear if Pasco County will allow a developer to build an apartment complex near a community of single-family homes.

A developer's plan to build an apartment complex in a  single-family home residential neighborhood in unincorporated New Port Richey remains on hold as Pasco County officials continue to explore the request. Residents in the neighborhood, just east of Little Road, near where the complex would be built have concerns and they've brought them up with the county.  On Thursday, We Are 5,533 Strong, a group that opposes the apartments, urged in an appeal hearing with the Pasco County Development Review Committee for county officials to stop the proposed apartment project. County staff have said that the project meets the county's land use codes. Instead of deciding to reject or accept the appeal, county officials decided to grant a continuance …

Opponents of Apartment Complex Plan Next Meeting

Potential neighbors in surrounding single-family subdivisions don't want to see the multi-story rental units on Amazon Drive.

Opponents of an apartment complex proposed for a 40-acre site surrounded by a sea of single-family homes have set a meeting for Aug. 30 to rally people to their cause and raise money for an expected legal challenge to the project. A number of residents in subdivisions near Amazon Drive where the complex would be built object to proposals of the property owner, Clearwater-based Scherer Development LLC, which has submitted site plans to Pasco County calling for 102 units in six, two-story buildings. The proposed site for the Oaks Apartments at Riverside Village is east of Little Road and slightly outside New Port Richey city limits.
